Contract Management and Adjudication Support

Fisher & Wallis approached Contract Rite requesting support on a labour only plumbing sub-contract for a proposed prestige retirement village. Their client’s contract consisted of approximately 50 new build dwellings, with the sub-contract valued at hundreds of thousands of pounds. The works were originally due to be delivered over a 7 month programme.

At the time of Contract Rite’s appointment, the project was approximately 5 months into the original contracted programme, but only around 30% of the works had been completed. Access available to Fisher and Wallis had been limited throughout the project, however, their client insisted that they provide the full team of labour in accordance with their original resources programme, irrespective of their ability to access the areas of their Works, threatening that any failure to provide such labour resources would result in large contra-charges.

Contract Rite’s initial involvement was to ensure that all contractual obligations were met, keeping precise records of progress and efforts to advance their Works throughout the build. Contract Rite’s involvement was then increased to provide full contract management services until project completion.

At project completion a Final Account valuation could not be agreed between the two parties. This resulted in Adjudication proceedings, where after multiple rounds the Adjudicator awarded Fisher & Wallis with fair payment, far greater than what was originally offered by their client during the final account negotiations.

Outcome

Following the decision, Matt Wallis stated “when we appointed Contract Rite to work with us on this Project we thought it was too late and we had serious insolvency concerns. Contract Rite’s performance was undoubtedly the reason why we were able to recover a fair payment on this Project and we cannot thank them enough for their efforts.”
